6 Notification of Overclaim Discrepancies profile

When a CDM Notification is created in accordance with the Notification of Overclaim Discrepancies profile that is sent by a licensee to a licensor in response to two or more CDM Statements received by the licensee that together indicate an Overclaim, the following Records shall be communicated in this order:

  1. One CDMH.01 Record.

  1. One or more summary Records of type CDS1.01.

  1. One or more overclaim discrepancy Records of type CDD2.01 that provide data describing:

    1. The type of the overclaim discrepancy;

    2. The location of the discrepancy in the CDM Statement received by the licensee from the licensor;

    3. Identification of the DspResourceId embodying the musical work which is the subject of the overclaim discrepancy;

    4. The nature of the usage of the resource;

    5. An indication of the royalties effected by the overclaim discrepancy;

  2. Two or more licensor specific Records of type CDD3.01 which follow each CDD2.01 Record.

This record provides data regarding the rights claims provided to the licensee from the two or more licensors whose claims contribute to the overclaim discrepancy.

  1. One SRFO Record.

 

If a licensee receives CDM Statement from one licensor which, on its own, contains an overclaim, the licensee should communicate this data to the licensor use the Notification of Data Discrepancies profile message as defined in Part 4 of this standard.

The Record types are defined in detail in Part 2 of the CDM Standard.

To indicate that a CDM Notification is created in accordance with the Notification of Overclaim Discrepancies profile, the Profile Cell in the CDMH.01 Record shall be set to OverclaimDiscrepancies and the ProfileVersion Cell to 2.0.
